What happens during escrow, step by step?

Every Las Vegas escrow follows a similar sequence. Here is what happens and what's expected of you at each stage.

Typical escrow in Las Vegas
30 to 45 daysFor a financed purchase. Cash can close much faster.
Earnest money due
1 business dayAfter acceptance on the standard contract, unless more time is written in for a wire.
HOA resale package review
5 calendar daysNevada law lets you cancel without penalty until midnight of the fifth day after you receive it.
  1. Day 1Escrow opens, earnest money due

As soon as both sides sign, the contract goes to the title or escrow company and escrow opens.

  2. First weekDisclosures and the HOA resale package arrive

The seller delivers the Seller's Real Property Disclosure and any other required disclosures within five calendar days.

  3. Due diligence periodInspections

Schedule your home inspection immediately, since good inspectors book fast.

  4. Before the due diligence deadlineReview disclosures and negotiate repairs

Nevada law requires sellers to disclose the defects they know about.

  5. Within about two weeksPreliminary title report

The title company sends a preliminary title report within ten business days of escrow opening.

  6. Throughout escrowAppraisal and loan underwriting

Your lender orders the appraisal and its underwriter reviews your full file: employment, assets, credit, tax returns, the appraisal, and the title report.

  7. As each deadline arrivesContingency deadlines pass

Your due diligence, appraisal, and loan protections each end on a date written into the contract.

  8. A few days before closingFinal walk-through and signing

You do a final walk-through to confirm the home is in the condition you agreed to and that any repairs were finished.

  9. Closing dayLoan funds, deed records, keys

Once your lender confirms funding, the escrow officer records the new deed in your name with the Clark County Recorder.

by the loan deadline you remove it in writing, renegotiate, or cancel.

HOA resale package

Nevada law (NRS 116.4109) gives you five calendar days after you receive it to cancel without penalty.

Title

Sale of your current home

only if your contract includes one.

During escrow

What should you do, and avoid, during escrow?

Small mistakes during escrow can delay or kill your closing.

Do these things

  • Respond to lender document requests the same day. Speed is everything in underwriting.
  • Keep your job and income steady. No career changes until after closing.
  • Read every disclosure, the HOA resale package, and every contingency before signing anything.
  • Confirm all wiring instructions by phone before sending funds.
  • Bring a wire or cashier's check for your closing funds. Personal checks are not accepted.
  • Ask your agent to clarify anything you do not fully understand.

Avoid these mistakes

  • Opening new credit accounts or taking on new debt. It can wreck your debt-to-income ratio.
  • Making large deposits or transfers without a paper trail your lender can document.
  • Buying a car, boat, or furniture before closing, since any new debt can disqualify your loan.
  • Wiring money based only on email instructions. Always verify by phone.
  • Changing banks or moving funds to different accounts during escrow.
  • Letting a contingency deadline pass before every open item has been resolved.

Closing day comes fast. Know what you pay at the table.

Questions

What do buyers ask during escrow?

Can I back out after my offer is accepted?

Yes, but timing matters. While a contingency deadline is still open, such as due diligence, appraisal, loan, or the HOA resale package review, you can cancel in writing and get your earnest money back. Once those deadlines pass, canceling without a reason the contract allows means the seller can keep your earnest money. This is why we never rush you past a deadline.

What if the appraisal comes in below the purchase price?

You have options. You can renegotiate the price with the seller, cover the gap in cash, or cancel with a copy of the appraisal before your appraisal deadline and get your earnest money back. On luxury transactions in Southern Highlands, we often set the appraisal deadline carefully for exactly this reason.

How long does escrow take in Las Vegas?

Standard escrow in Las Vegas runs 30 to 45 days for financed purchases. Cash purchases can close in as few as 7 to 10 days since there is no loan underwriting. The closing date is negotiated in the purchase agreement, and with a well-prepared lender and a straightforward deal we often recommend about 30 days.

What can delay or kill my escrow?

The most common causes are underwriting delays from slow document responses, a low appraisal, a title search that turns up unexpected liens, failed repair negotiations, and last-minute financial changes on the buyer's side. We watch each stage and catch issues before they become problems.

Who chooses the title and escrow company in Nevada?

The title and escrow company is named in the purchase agreement, so both sides agree to it. When you are getting a mortgage, federal law (RESPA Section 9) says a seller cannot require you to buy title insurance from a particular company as a condition of the sale. We work with a small group of trusted Las Vegas title partners and are happy to recommend one. Title and escrow rates in Nevada are filed with the state Division of Insurance.

What is an HOA resale package?

It is the set of documents a Nevada HOA must provide when a home sells: the CC&Rs, bylaws, rules, budget and reserve summary, current dues, any unpaid amounts, and fees due on transfer. The seller orders and pays for it. You have until midnight of the fifth calendar day after you receive it to cancel without penalty.

Do I need to be present for closing?

You need to sign your loan documents in front of a notary, at the title company or through remote online notarization if your lender and title company support it. Signing usually happens a few days before the closing date. The deed records and keys change hands after your lender confirms funding.

What should I do about property taxes after I close?

Make sure your primary residence gets Nevada's 3% cap on property tax increases. Clark County says any recorded ownership change removes the owner-occupied abatement, and the Assessor mails a postcard to new owners that you return to claim it. Your share of the year's taxes is prorated at closing.

What happens after your offer is accepted?

Escrow opens, your earnest money goes in, and the clock starts on every deadline in your contract. Your offer was accepted. Congratulations, but the work isn't over! Here is exactly what happens between contract and keys, and what's expected at every step.

What does "in escrow" actually mean?

Escrow is the period between a signed purchase contract and the day you officially own the home. A neutral third party, the escrow or title company, holds all funds and documents until every condition of the contract has been met.

Think of escrow as a controlled handoff. No money moves and no deed transfers until both the buyer and the seller have done what they agreed to. This protects you, the seller, and the lender equally.

In Las Vegas, escrow typically runs 30 to 45 days for a financed purchase. On the standard purchase agreement, escrow opens within one business day of acceptance. During that window you will be working with your lender, your agent, the title company, and inspectors at the same time. Knowing what to expect at each stage makes the whole process far less stressful.

Which contingencies protect you in a Nevada escrow?

Contingencies are the exits in your contract, and each one has its own deadline. Understand each one before you let it pass.

  • Due diligence: a set number of calendar days to inspect and investigate. You can cancel for any reason during it and get your earnest money back.
  • Appraisal: if the home appraises below the price, you can renegotiate or cancel with a copy of the appraisal by the appraisal deadline.
  • Loan: by the loan deadline you remove it in writing, renegotiate, or cancel.
  • HOA resale package: Nevada law (NRS 116.4109) gives you five calendar days after you receive it to cancel without penalty.
  • Seller's disclosure: if the seller discloses a defect in writing before closing, Nevada law (NRS 113.150) lets you rescind, with a written, notarized notice served on escrow within 4 working days.
  • Title: five business days after you receive the preliminary title report to object.
  • Sale of your current home: only if your contract includes one.
