The art of Making an Offer

The art of Making an Offer

A well-crafted offer does more than name a price: it signals credibility, sets the tone, and positions you to win in any market. Here's exactly how we do it.

The process

How does the offer process work in Las Vegas?

Most offers go from first draft to a signed contract in a few days. Here is what every step looks like, and when we get involved.

  1. Before you writeComparative market analysis

Before any number goes on paper, we pull a CMA: recent sales, days on market, and price per square foot for comparable homes in your target area.

  2. Day 1Structuring the offer

Purchase price is just the start.

  3. Within 24 to 72 hoursOffer submitted and response

We present directly to the listing agent.

  4. If neededCounteroffer negotiation

We weigh every response against market data and advise on when to hold, counter, or give on specific terms.

  5. Offer acceptedSigned contract and next steps

Once both sides sign, escrow opens within one business day and your earnest money goes to escrow within one business day, unless the contract allows more time for a wire.

Earnest money and due diligence

How do earnest money and due diligence work in Nevada?

Your deposit is protected if you cancel within the deadlines in your contract, and it is at risk once they pass.

  1. Where your earnest money goes

It is deposited with the escrow company within one business day of acceptance, or within the number of business days written in for a wire.

  2. The due diligence period

You get a set number of calendar days from acceptance to inspect and investigate.

  3. Appraisal and loan deadlines

If the appraisal comes in below the price, you can renegotiate or cancel with a copy of the appraisal by the appraisal deadline.

  4. The HOA resale package

If the home is in an HOA, the seller orders the resale package within two business days and pays for it.

  5. The Seller's Real Property Disclosure

The contract has the seller deliver it within five calendar days of acceptance, and Nevada law (NRS 113.130) requires it at least 10 days before closing.

  6. After the deadlines pass

Once your protections have lapsed, backing out without a reason the contract allows is a default.

General information, not legal advice. We walk you through every contingency before you sign.

Negotiating

How do you negotiate on a Las Vegas home?

Price is only one part of a negotiation.

When the market favors buyers

  • Offer below asking when days on market are high or price reductions suggest the seller is flexible.
  • Ask for seller concessions: closing cost credits, prepaid HOA dues, or a home warranty can add real value.
  • Negotiate inspection repairs as credits, not work orders. It gives you control over quality and cost.
  • Use a longer closing window as leverage if the seller needs time before moving out.

When you are competing for a home

  • Escalation clauses let you automatically beat other offers up to a ceiling, without blindly overpaying.
  • Larger earnest money signals conviction and lowers the seller's risk, often more compelling than a higher price alone.
  • Shorten deadlines strategically. We tell you exactly which protections carry real risk to give up and which are standard.
  • Pre-approval from a local lender carries more weight than a big-bank letter, and we have relationships that help.

Questions

What do buyers ask about making an offer?

How much earnest money should I put down on a house in Las Vegas?

Between 1 and 3% of the price is standard on Las Vegas luxury homes, and some sellers expect more in a competitive situation. It is credited to you at closing. We recommend an amount based on the home, the competition, and how much risk you are comfortable with.

When is earnest money due in Nevada?

On the standard Las Vegas purchase agreement, earnest money goes to escrow within one business day of acceptance, or within the number of business days written into the contract for a wire. Always call the escrow company to confirm wiring instructions before you send money.

How long is the due diligence period in Nevada?

There is no fixed number in state law. The number of calendar days is written into your purchase agreement and counted from acceptance. During that time you can inspect the home and cancel for any reason with a full refund of your earnest money.

Can I back out after my offer is accepted?

Yes, as long as you cancel in writing within one of your contract deadlines: due diligence, appraisal, loan, or the 5 day HOA resale package review. After those deadlines pass, backing out without a reason the contract allows puts your earnest money at risk.

What happens if the appraisal comes in lower than my offer?

You can pay the difference in cash, ask the seller to lower the price, meet in the middle, or cancel with a copy of the appraisal before your appraisal deadline and get your earnest money back. We plan for this before you offer, especially on homes priced above recent sales.

How long does a seller have to respond to an offer?

Until the deadline written into the offer. Most Las Vegas sellers respond within 24 to 72 hours with an acceptance, a counteroffer, or a rejection. If they do not respond by the deadline, the offer expires.

Should I offer over asking price in Las Vegas?

It depends on the home, not the headline. A home that just listed in a popular neighborhood with several offers may sell over asking, while one that has sat for weeks or had price cuts usually leaves room to offer under. Our CMA tells us which one you are looking at.

Who pays the transfer tax and title insurance in Las Vegas?

By local custom in Clark County, the seller pays the real property transfer tax and the owner's title insurance policy, and the escrow fee is split. You pay your lender's fees and the lender's title policy. All of it can be negotiated, and the purchase agreement has a line for each one. Our closing costs guide has the full breakdown.

What should you know before you make an offer in Las Vegas?

An offer in Las Vegas is a signed Residential Purchase Agreement, and the seller reads every term in it, not only the price. It sets your price, your earnest money, your due diligence period, your loan and appraisal deadlines, and your closing date. A well-crafted offer does more than name a price: it signals credibility, sets the tone, and positions you to win in any market. Here's exactly how we do it.

What goes into a strong offer?

Every term sends a signal, and in a competitive luxury market the seller compares all of them, not just the price. Here's what we include, and why each one matters.

Purchase price

Grounded in our CMA and the current market temperature, not gut feel. We advise whether to offer at, above, or below list price based on real data, including how long the home has been listed and whether the price has already dropped.

Earnest money deposit

A deposit that shows good faith. In Las Vegas luxury transactions, 1 to 3% of the price is standard. We recommend the amount that signals seriousness without unnecessary risk, and it is credited back to you at closing.

Due diligence period

Your window to inspect the home, check insurance, and review the seller's disclosures, with the right to cancel for any reason and get your deposit back. The number of days is negotiated. A shorter period makes the offer stronger, but it has to leave time for the inspections you need. We have a trusted network of inspectors who know high-end Las Vegas homes, pools, and roofs.

Loan and appraisal deadlines

Protects your earnest money if your loan falls through or the home appraises below the price. Each one has its own deadline in calendar days. We discuss how long to allow, and how the strength of your pre-approval affects your leverage.

Closing timeline

A flexible or quick close can be as compelling as the price itself. We gauge the seller's situation and recommend a timeline that gives you an edge without putting pressure on your side.

Inclusions and exclusions

What stays, what goes. The standard contract already includes attached fixtures such as built-in appliances, pool and spa equipment, solar systems, and garage door openers. Furniture, art, and other personal property have to be listed. In high-end homes this gets specific, and we document everything clearly so there are no surprises at the walk-through.

How do earnest money and due diligence work in Nevada?

Your deposit is protected if you cancel within the deadlines in your contract, and it is at risk once they pass. Here is how it works on the standard Las Vegas purchase agreement.

Where your earnest money goes

It is deposited with the escrow company within one business day of acceptance, or within the number of business days written in for a wire. Escrow holds it until closing, where it counts toward your down payment and closing costs. If the deal is cancelled, escrow releases it on cancellation instructions signed by both sides, which is why written notices and deadlines matter.

The due diligence period

You get a set number of calendar days from acceptance to inspect and investigate. During that time you can cancel in writing for any reason and get a full refund, or resolve your objections with the seller in writing. If the deadline passes and you have done neither, the contract treats the due diligence condition as waived.

Appraisal and loan deadlines

If the appraisal comes in below the price, you can renegotiate or cancel with a copy of the appraisal by the appraisal deadline. By the loan deadline you remove the loan contingency in writing, renegotiate, or cancel. Let either deadline pass and that protection is waived.

The HOA resale package

If the home is in an HOA, the seller orders the resale package within two business days and pays for it. Nevada law (NRS 116.4109) gives you until midnight of the fifth calendar day after you receive it to cancel without penalty. If it has not arrived within 15 calendar days of acceptance, you can cancel.

The Seller's Real Property Disclosure

The contract has the seller deliver it within five calendar days of acceptance, and Nevada law (NRS 113.130) requires it at least 10 days before closing. It lists defects the seller knows about. It is not a warranty and does not replace your own inspection.

After the deadlines pass

Once your protections have lapsed, backing out without a reason the contract allows is a default. On the current form, the seller's remedy is to keep the earnest money.

Every transaction is different. We walk you through every contingency before you sign.
